JANICE MCMASTERS, CENTRAL RURAL ELECTRIC COOPERATIVE, PARNON HOLDINGS, INC., AS SUCCESSOR-IN-INTEREST TO PARNON GATHERING, INC., JOHN KERR, LINDMARK ACQUISITION, LLC, GLADSTONE CAPITAL CORPORATION, BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF PAYNE, AND TREASURER OF PAYNE COUNTY.” The action alleges that the Defendants may possess some right, title, lien, estate, encumbrance, claim, assessment, or interest in and to the real property that is the subject of the action, as described in the Petition filed herein (the “Property”). You are hereby notified that you have been named as a Defendant in the District Court of Payne County, Oklahoma, by Oklahoma Natural Gas Company, a division of ONE Gas, Inc. (“Plaintiff”), in a proceeding for the determination of damages for the acquisition by condemnation of a permanent easement, additional temporary workspace, and additional workspace for the construction, operation, and maintenance of a pipeline and related equipment across, under, and upon the Property. You are informed that on the 17 day of Septemeber, 2015, at the hour of 9:00 o'clock a.m., or as soon thereafter as counsel may be heard, Plaintiff will make application to the Judge of the District Court of Payne County, Oklahoma, for an Order determining that Plaintiff has the right to acquire the permanent easement, additional temporary workspace, and additional workspace described in the Petition by condemnation and appointing three (3) disinterested freeholders of said county as commissioners, who shall be selected by said Judge to view the Property and consider the injury sustained to the Property by reason of the taking, and to assess the damages as a result thereof, at which time you may be present if you so desire. You are further informed that once the Report of Commissioners is filed with the District Court Clerk, you have thirty (30) days from the filing of such Report within which to file written exception to said Report and sixty (60) days from the filing of said Report within which to file a demand for jury trial, in which case your damages shall be assessed at trial by a jury. If written exception to said Report or a demand for jury trial is not filed within the time set forth herein, the damages assessed in the Report of Commissioners will become final and Plaintiff will have acquired, by condemnation, the easements above-described.
