(First Published August 30, 2015) NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS Date of Notice: August 30, 2015 City of Joplin 602 South Main Street Joplin, Missouri 64801 417-624-0820 On or about September 14, 2015 the City of Joplin will submit a request to the Department of Housing and Urban Development for the release of Community Development Block Grant Disaster Relief (CDBG-DR) funds under Title 1 of the Housing and Community Development Act of 1974 (PL 93-383) and HUD Grant Number DR-2013-01-B-1 to undertake the following project: Project Title: City of Joplin Wastewater Collection System The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 as the sanitary sewer lines to be replaced and/or reconstructed will be retained in the same use without change in size or capacity of more than 20 percent. The purpose of the project is to reconstruct and improve the wastewater collection system in the City of Joplin. The work included in this notice is part of the next phase of the sanitary sewer replacement and includes the following: Shoal Creek interceptor replacement/upgrades which is anticipated to begin in the vicinity of 32nd Street and Mohaska, then going northeast to near 27th Street and Joplin Avenue, then along 27th Street east to approximately Missouri Avenue. Branches of sanitary sewer lines extending along Murphy and east of Sergeant to the north and southeast to near 28th Street and Virginia Avenue will also be addressed as part of this work Bartlett sewer replacement/upgrades which is anticipated to begin the vicinity of 32nd Street and McIntosh, going northwest to near 26th Street and McCoy and then northwest to approximately 25th Street and Willard Avenue The estimated cost of the funds requested for design and associated construction activities requested is $2,905,757.A large portion of this area was devastated as a result of the May 2011 tornado. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the City of Joplin, Planning and Community Development Department, 602 South Main Street, Joplin, Missouri 64801 and may be examined or copied weekdays 8A.M. to 5 P.M. PUBLIC COMMENTS Any individual, group, or agency may submit written comments on the ERR to the City of Joplin or via email to cdbgdr@joplinmo.org. All comments received by September 14, 2015 will be considered by the City of Joplin prior to authorizing submission of a request for release of funds. RELEASE OF FUNDS The City of Joplin certifies to HUD that Samuel Anselm in his capacity as City Manager consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD's approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the City of Joplin to use HUD program funds. OBJECTIONS TO RELEASE OF FUNDS HUD will accept objections to its release of funds concurrently with the City of Joplin's comment period until September 14, 2015 or for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the City of Joplin; (b) the City of Joplin has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD at Gateway Tower II, Room 200, 400 State Avenue, Kansas City, Kansas 66101.
