Case No. CJ-15-101 NOTICE OF SHERIFFS SALE Notice is hereby given that pursuant to a Writ of Special Execution and Order of Sale (Writ) issued by the Court Clerk of Mayes County, on the 21st day of August, 2015, in an action pending in the District Court of Mayes County, Case No. CJ-2015-101, wherein Vicki Diel and Daniel Diel (Defendants), were Defendants, commanding me to levy upon real property belonging Defendants, to satisfy a Judgment rendered therein in favor of the Plaintiff, HARBOUR PORTFOLIO VII, LP and against Defendants for the aggregate of the principal amount of Thirty-Seven Thousand Six Hundred Ninety Three and 56/100 Dollars ($37,693.56), as of March 23, 2015, togeth with interest thereon, at the rate of 10%, in the amount of Two Thousand Three Hundred Eighty-Five adn 54/100 Dollars ($2,385.54) as of March 23, 2015, and thereafter at the rate of Ten and 33/100 Dollars ($10.33) per diem until paid, plus One Hundred Twenty-Six and 88/100 Dollars ($126.88) in fees, minus credits of Nine Hundred Fourteen and 80/100 Dollars ($914.80) for taxes and insurance, plus the actual abstracting expenses, together with the reasonable attorney fees in the amount of Three Thousand Five Hundred Dollars ($3,000.00), the cost of this action in the amount of Three Hundred Seventy-Three and 70/100 Dollars ($373.70) as of July 28, 2015, and any further costs or expenses accured and accruing. I have levied upon certain land and hereditaments belonging to Defendants, Vicki Diel and Daniel Diel, situated in said Mayes County described as: The West Fifty-eight (58) feet of Lot Numbered Three (3) in Block Numbered Three (3), of the Town of Chouteau, Mayes County, State of Oklahoma, according to the Offical Survey and Plat thereof, filed for the record in the office of the County Clerk of said County and State. commonly known as 315 W. Cherokee, Chouteau, OK 74337 and have duly caused said real property to be appraised according to law at $33,000.00. NOW, WHEREFORE, notice is hereby given that pursuant to the commands of the said Writ, I will offer for sale and sell for cash to the highest and best bidder to satisfy the Judgment on the 1st day of October, 2015, at 10:00 a.m. of said day, at the Mayes County Courthouse, in the City of Pryor, Mayes County, State of Oklahoma.
