SHERIFF SALE Wednesday, September 23, 2015 AT 1:30 P.M., EST In The Office of the Union County Sheriff REAL ESTATE By virtue of a Writ of Execution issued out of the Court of Common Pleas of Union County, Pennsylvania, to Execution Docket No: 15-112; Mifflinburg Bank and Trust Company v. Robert A. Knouse, d/b/a RAK Trucking. TRACT NO. 1: ALL THAT CERTAIN one-half (1/2) interest in and to that certain messuage or tenement and tract of land situate in Limestone Township, Union County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the centerline of Township Road No. 309 and said point being the Northeast corner of the within tract of land; THENCE through Township Road No. 309 and along land now or formerly of Patricia Underhill, South two degrees thirty-four minutes West (S. 2^ 3 4 ' W.), a distance of two hundred forty-five feet (245.00') to an iron pin (passing through an iron pin set on the edge of Township Road 309); THENCE along land of same, South forty-eight degrees thirty-four minutes West (S. 48^ 34' W.), a distance of thirty-seven and eight hundredths feet (37.08') to a point on the edge of Penns Creek (passing through a set iron pin set twelve and eight hundredths feet (12.08') from corner of Penns Creek); THENCE along the edge of Penns Creek, South eighty-eight degrees five minutes West (S. 88^ 05' W.), a distance of two hundred forty-nine and six hundredths feet (249.06') to a point along the edge of Penns Creek; THENCE along the same, North eighty-six degrees fifty minutes West (N. 86^ 50' W.), a distance of one hundred forty-two and twenty-five hundredths feet (142.25') to a point along the edge of Penns Creek; THENCE along the same, South eighty-one degrees fifty-three minutes West (S. 81^ 53' W.), a distance of three hundred thirty and twenty-four hundredths feet (330.24') to a point along the edge of Penns Creek; THENCE along lands now or formerly of Edward L. Weikel, North two degrees sixteen minutes East (N. 2^ 16 E.), a distance of five hundred one and eighty-seven hundredths feet (501.87') to a point on the centerline of Township Road No. 309 (passing through an iron pin set on the edge of Township Road 309); THENCE along the centerline of Township Road No. 309, South seventy-eight degrees eleven minutes East (S. 78^ 11' E.), a distance of two hundred twenty-six and thirty-seven hundredths feet (226.37') to a point on the centerline of Township Road No. 309; THENCE along the same, South seventy-five degrees thirty-two minutes East (S. 75^ 32' E.), a distance of one hundred forty and twenty-four hundredths feet (140.24') to a point on the centerline of Township Road No. 309; THENCE along the same, South seventy-three degrees thirty-six minutes East (S. 73^ 36' E.), a distance of two hundred fifty-five and seventeen hundredths feet (255.17') to a point on the centerline of Township Road No. 309; THENCE along the same, South seventy-six degrees forty-five minutes East (S. 76^ 45' E.), a distance of one hundred thirty-eight and thirty-six hundredths feet (138.36') to a point on the centerline of Township Road 309, the place of BEGINNING. CONTAINING six and forty-five hundredths acres (6.45 A.) as per survey of Wagner's Surveying dated July 20, 2000 and recorded November 19, 2001 to Union Count Register and Recorder's Office in Plat Book 22, Page 3. WHEREON is erected a two (2) story frame dwelling. TRACT NO. 2: ALSO, ALL THAT CERTAIN one-half (1/2) interest in and to that certain messuage or tenement and lot of ground situate in Limestone Township, aforesaid, bounded on the North by Penns Creek; on the East, South and West by land now or formerly of Jonathan Shemory and Joseph Geiswite. CONTAINING eleven acres, more or less. BEING THE REMAINDER TRACT OF LAND OF TRACT NO. 1 AND ALL OF TRACT NO. 2 set forth on Deed from EDGAR W. KNOUSE, a widower, dated January 28, 2000 and recorded February 8, 2000 in the Union County Register and Recorder's Office in Record Book 771, at Page 283, granted and conveyed unto EDGAR W. KNOUSE, a widower, ROBERT A. KNOUSE, a single person, GALE P. KNOUSE, a single person, and GREGORY D. KNOUSE, a married person, as Joint Tenants with Right of Survivorship. The said EDGAR W. KNOUSE died on September 1, 2000 whereby operation of law the title became vested into ROBERT A, KNOUSE, a single person, GALE P. KNOUSE, a single person, and GREGORY D. KNOUSE, a married person, each having a one-third interest. The said GREGORY D. KNOUSE is currently married to LINDA KNOUSE. LINDA KNOUSE is joining in the signing of this Deed to release all rights, marital or otherwise, in the subject realty. ALSO BEING the same premises that Gregory D. Knouse and Linda Knouse, husband and wife, by their deed dated November 16, 2001 and recorded November 19, 2001 to Union County Record Book 933, Page 39, granted and conveyed his one-third (1/3) interest unto Robert A. Knouse, a single person, and Gale P. Knouse, a single person, each having a one-half (^) interest held as joint tenants with the right of survivorship. BEING PREMISES 509 Penns Creek Road, Mifflinburg, PA TAX PARCEL NO.: 009-091-050&009-091-049 CONDITIONS OF SALE The real property will be sold subject to the following conditions of sale; ten percent (10%) of the higher sum bid struck off shall be deposited in each case with the Sheriff by the highest bidder when his bid is registered, provided that in no case shall less than One Hundred Dollars ($100.00) be deposited and that in each case the deposit shall be sufficient to cover the Sheriff s costs; otherwise upon failure or refusal to make such deposit, the bidder shall lose all benefits of his bid and the property may be immediately put up again and sold unless a deposit of the required bid made by a second bidder willing to take the property at the highest bid price. The balance shall be paid on or before October 13, 2015. The sale is also subject to Pennsylvania Transfer Tax, plus County Poundage. Notice is hereby given all claimants and parties in interest that the Sheriff will for all sales where filing of schedule of distribution is required, file the said schedule of distribution not later than thirty (30) days after the sale, in his office, where the same will be available for inspection and that distribution will be made in accordance with the schedule, unless exceptions are filed thereto within twenty (20) days thereafter.
