PB_2015-149 (Published in the Saturday editions of The Duncan Banner, September 5 and 12, 2015-2 times) IN THE DISTRICT COURT WITHIN AND FOR STEPHENS COUNTY STATE OF OKLAHOMA IN THE MATTER OF THE ESTATE OF RALPH M. COLE, DECEASED Case No. PB-2015-149 COMBINED NOTICE TO CREDITORS AND NOTICE OF HEARING TO: ALL PERSONS INTERESTED IN THE ESTATE OF RALPH M. COLE, DECEASED YOU ARE NOTIFIED that on the 1st day of September, 2015, the Petitioners, DAVID GRADY COLE, 6224 E. Oxbow Loop, Bossier City, LA 71112, and his brother, STEVEN EARL COLE, 113 Designer Circle, Dothan, AL 36303, filed in the District Court of Stephens County, Oklahoma, a Petition for Summary Administration, Appointment of Co-Special Administrators and Admission of Foreign Will to Probate. The Petitioners have alleged that RALPH M. COLE, age 95, departed this life while a good faith resident of Katy, Harris County, Texas, on the 5th day of February, 2015, owning an undivided interest in minerals in Stephens and Carter Counties, both in Oklahoma, in the State of Oklahoma. The total value of the decedent's property in Oklahoma is $16,072.40. Attached to the Petition is a duly exemplified copy of the Last Will and Testament bearing the date of the 26th day of February, 1982, a First Codicil to such Will dated April 30, 1985, and a Third Codicil to such Will dated January 14, 2013 with the Order Admitting Will to Probate and Granting Letters Testamentary of the probate filed in the Probate Court No. 3 of Harris County, Texas, in Cause No. 437,427, showing probate of said Will in said County and State. The Petitioners have asked that this Court admit the Last Will and Testament bearing the date of the 26th day of February, 1982, a First Codicil to such Will dated April 30, 1985, and a Third Codicil to such Will dated January 14, 2013 to pro bate in the State of 0 Oklahoma and order summary proceedings pursuant to OK ST T. 58 §245, et seq. In an Order for Combined Notice entered herein, this Court found that it should dispense with the regular estate proceedings prescribed by law and order Notice to Creditors and issue an Order for a hearing upon the Petition for Summary Administration, Appointment of Co-Special Administrators and Admission of Foreign Will to Probate, the Final Accounting and Petition for Determination of Heirs, Legatees and Devisees and Distribution. Pursuant to the Order for Combined Notice, all creditors having claims against Ralph M. Cole, deceased, are required to present the same, with a description of all security interests and other collateral, if any, held by each creditor with respect to such claim, to David Grady Cole and Steven Earl Cole, in care of LEACH & SULLIVAN, 921 Main, Duncan, Oklahoma, 73533, on or before the 1st day of October, 2015, or the same will be forever barred. NOTICE IS HEREBY GIVEN that a hearing will be held on the 27th day of October, 2015, at 10:00 o'clock a.m., at the Stephens County Courthouse, Duncan, Oklahoma, before the Honorable Judge of said Court. At the hearing, the Court will decide whether to approve the Petition for Summary Administration, Appointment of Co-Special Administrators and Admission of Foreign Will to Probate and the Final Account and Petition for Determination of Heirs, Legatees and Devisees and Distribution of the Petitioner. The Final Account and Petition for Determination of Heirs, Legatees, Devisees and Distribution will be filed herein at least twenty (20) days prior to the hearing aforesaid.
