September 21, 2015 Appanoose County Board of Supervisors met in regular session September 21, 2015 at 9:00 A.M. in the Boardroom of the Courthouse. Present: Jody McDanel, Chairman via conference call and Neal Smith and Mark Waits, Boardmembers. Absent: None. Smith moved to approve the agenda. Seconded by Waits. All voted aye. Waits moved to approve minutes from the September 8, 2015 meeting. Seconded by Smith. All voted aye. Waits moved to approve jailer appointment of Marilyn Wood effective September 21, 2015. Seconded by Smith. All ayes. Waits moved to table tax abatement request from SIEDA. Seconded by Smith. That following the public hearing an auction will be held in which the property will be sold to the highest bidder with the county reserving the right to accept for reject any or all bids; who will also pay the current year's taxes, the cost of publication of this notice and the cost of recording the deed. 3. McDanel opened the public hearing on road vacation. Brad Grothe spoke representing Jeremy Long. Rick Lynch spoke representing Henry Opperman. Waits moved to close the public hearing. Seconded by Smith. All voted aye. Smith moved to approve resolution vacating road. Seconded by Waits. All ayes. RESOLUTION WHEREAS, a request has been made by the County Engineer to vacate a county road which is described as follows: A portion of 480th Street beginning 20 feet west of the interesection of 480th Street with the east line of the SWl/4, SWl/4 of Section 10, T69N,R17W of Douglas township, thence Northwest to where this vacation ends at the west line of the SWl/4, SWl/4 of Section 10, T69N,R17W. A portion of 249th avenue beginning 740 feet north of the intersection of 493rd and 249th Avenue, thence N to a point 30 feet south of the north line of the SW1/4 SW1/4 of Section l0, T69N,R17W. Said road was established as a portion of the A.E. White road No. 527. WHEREAS, on the 10th day of September, 2015 notice of said hearing was sent by certified mail to the affected property owners, all utility companies whose facilities are on the road right-of-way and the Iowa Department of transportation; and WHEREAS, on the 16th day of September, 2015 a Notice of Public Hearing for the proposed road vacation was published in the Ad-Express and Daily Iowegian, newspapers of general circulation in the County where said road is located; and WHEREAS, a hearing was held by the Appanoose County Board of Supervisors on the 21st day of September, 2015; and WHEREAS, the Appanoose County Board of Supervisors have determined that provisions of Chapter 306 of the Iowa code have been met and no damages are due; and WHEREAS, it has been determined in the best interest of the County and the affected property owners that the County not purchase the vacated road, but instead transfer said road to the adjoining property owners by resolution; and WHEREAS, the adjoining property owners are as follows: l. John Glick and Linda Constable NOW, THEREFORE, BE IT RESOLVED, by the Appanoose County Board of Supervisors the above-described described road is hereby vacated and ownership of same is transferred to the adjoining property owners.
