SUBSTITUTE TRUSTEE'S NOTICE OF SALE NOTICE is hereby given that on Thursday, October 22, 2015, at 2:00 oclock, P.M. at the Main Street entrance of the Cumberland County Courthouse in Crossville, Tennessee, the undersigned, as Substitute Trustee, under a Deed of Trust executed by Alvin R. Scheele and wife, Earleen Scheele (the Debtors), dated February 7, 2008, of record at Book 1285, page 2459, et seq., Register's Office, Cumberland County, Tennessee; said Deed of Trust being assigned by Paul E. Underwood and wife, Linda C. Underwood to the Fairfield Glade Community Club by Assignment of Promissory Note and Deed of Trust dated August 31, 2015, of record at Book 1459, page 969, et seq., Register's Office, Cumberland County, Tennessee; and, by virtue of being appointed Substitute Trustee by the true and lawful holder and owner of said indebtedness by an instrument dated September 15, 2015, of record at Book 1460, page 359, et seq., Register's Office, Cumberland County, Tennessee, by reason of default in the payment of the obligation secured by said deed of trust and fixture filing and the performance of the covenants therein contained, and at the express direction of the true and lawful holders and owners of said promissory note secured by said deed of trust and fixture filing, will sell, at public auction, to the highest bidder for cash, or credit upon the indebtedness secured, at the option of the holder of the secured indebtedness if the holder is the successful bidder, the interest conveyed to said Substitute Trustee by virtue of said deed of trust and fixture filing, and the property therein described, which property lies in the SECOND CIVIL DISTRICT of Cumberland County, Tennessee, and is more particularly described as follows: Being Lot No. 198, Block 1, Wilshire Addition to Fairfield Glade, a plat of which appears of record at Plat Book 3, page 19, Register's Office, Cumberland County, Tennessee. The conveyance of this property will be made expressly subject to the terms and provisions of the Amended and Restated Declaration of Covenants and Restrictions for Fairfield Glade dated November 5, 1997, of record at Book 1006, page 1986, et seq., Register's Office, Cumberland County, Tennessee; the reservation of all oil, gas, and other minerals under the subject property by Fairfield Communities, Inc.; and, to building set-back lines, utility easements, and other matters as appear on the plat of Block 1, Wilshire Addition to Fairfield Glade, at Plat Book 3, page 19, said Register's Office. This property is identified as Map 65-F, Group B, Parcel 23.00 in the records of the Assessor of Property for Cumberland County, Tennessee. Other interested parties: None. The provisions of Tennessee Code Annotated 35-5-117, regarding the Notice of the Right to Foreclose do not apply. This sale will be made in bar of the equity and right of redemption without warranty as to title or encumbrances for the purpose of paying the debt obligation secured by said deed of trust. Said sale shall be subject to any restrictions, reservations, conditions and liens of record applicable to said property, and is further subject to any County real property taxes against said property.
