___________________________________ LEGAL NOTICE ___________________________________ BEFORE THE CORPORATION COMMISSION OF OKLAHOMA APPLICANT: GULF EXPLORATION, L.L.C. RELIEF SOUGHT:POOLING LAND COVERED:NW/4 SE/4 OF SECTION 10, TOWNSHIP 5 NORTH, RANGE 4 EAST, PONTOTOC COUNTY, OKLAHOMA CAUSE CD NO. 201504761 NOTICE OF HEARING STATE OF OKLAHOMA TO: All persons, owners, producers, operators, purchasers and takers of oil and gas and all other interested persons, particularly in Pontotoc County, Oklahoma, and more particularly: Blue Baron Energy, LLC; C.W. Hardy c/o Michael A. Porter; Grace A. Smith, formerly Grace A. Hawkins; Jacquita Stephen and Drew V. Finley, Jr., Trustees Under the Last Will and Testament of Henry C. Stephen III; Richard Lee Hawkins; Henry C. Stephen, III; Henry C. Stephen, Jr.; Lee O. Hawkins; Sadie Fleming; and, if any of the above-named individuals are deceased, the unknown heirs, executors, administrators, devisees, trustees, successor trustees and assigns, immediate and remote, of any such deceased person; and, if any of the above-named corporations or companies are no longer in existence, then the unknown successors and assigns of any such corporation or company. NOTICE IS HEREBY GIVEN that the Applicant in this cause is requesting that the Commission pool the interests and adjudicate the rights and equities of oil and gas owners in the Upper Wewoka, Middle Wewoka, Lower Wewoka, Calvin, Senora, Thurman, Earlsboro, Basal Pennsylvanian Unconformity, Misener, Hunton, Sylvan, Viola, Simpson Dolomite, First Wilcox, Second Wilcox, Oil Creek and Arbuckle common sources of supply underlying 40-acre well drilling and spacing unit comprised of the NW/4 SE/4 of Section 10, Township 5 North, Range 4 East, Pontotoc County, Oklahoma, and designate Gulf Exploration, L.L.C. or some other owner as operator, all to be upon such terms and conditions are just and reasonable and which will afford all of such owners the opportunity to recover or receive without unnecessary expense their just and fair share of all hydrocarbon substances produced therefrom, and that the Commission make definite provisions for the payment of all actual costs and expenses, not to exceed reasonable costs and expenses of drilling and development, including a reasonable charge for supervision. The Applicant shall request at the hearing that the order provide that any owner electing an alternative to participation in the initial well drilled thereunder shall be deemed to have relinquished all of its working interests and right to drill in the unit and common sources of supply named herein as to such well and any wells drilled subsequent thereto. Applicant may propose that the order to issue in this cause provide a method for proposal of subsequent wells and for response to such proposal by owners who elect to participate in the initial well. In addition, Applicant may request that the order issued herein provide that the Applicant/Operator shall have a period of twelve (12) months from the date of said order within which to commence operations to drill or rework the initial well covered by said order. Applicant may request such additional relief as the Commission deems appropriate. NOTICE IS FURTHER GIVEN that the Applicant may request that the order to be entered in this cause be made effective on a date prior to the date of the order and for such other and further relief as the Commission deems proper. NOTICE IS FURTHER GIVEN that this cause be set before an Administrative Law Judge for hearing, taking of evidence and reporting to the Commission. NOTICE IS FURTHER GIVEN that this cause will be heard before an Administrative Law Judge on the Initial Hearing Docket at the Corporation Commission, Western Regional Service Office, 2101 N. Lincoln Blvd., Jim Thorpe Building, Oklahoma City, Oklahoma, at 8:30 a.m., on the 19th day of October, 2015, and that this notice be published as required by law and the rules of the Commission. NOTICE IS FURTHER GIVEN that the Applicant and interested parties may present testimony by telephone. The cost of telephonic communication shall be paid by the person or persons requesting its use. Interested parties who wish to participate by telephone shall contact the Applicant or Applicant’s Attorney, prior to the hearing date, and provide their name and phone number.
