Published in the Tahlequah Daily press on June 20, 2018 RESOLUTION NO. 06-11-18-A WHEREAS, the City Council of the City of Tahlequah, Oklahoma, had been requested by various interests thereof to submit to the Electors of the City of Tahlequah, Oklahoma at a special election to be called and fixed by the Mayor submitting to the Electors of the City of Tahlequah, Oklahoma, the proposition of enactment of an ordinance numbered 1263-2018 in form and substance as attached hereto, copies of which are on file and available at the office of the City Clerk during normal business hours, such ordinance assessing an excise tax of 6% upon the gross proceeds and gross receipts derived from rental received from occupancy of substantial hotel rooms for a period of 25 years from the effective date of such ordinance. AND WHEREAS, it has been further suggested by such interests that a portion of the revenue to be derived from the assessment of such excise tax be rebated back to the operator of any newly-constructed substantial hotel within the City of Tahlequah for a maximum period of 20 years from the date of placing that particular substantial hotel into operation as an incentive to develop new substantial hotels within the City of Tahlequah, and that such funds be used 96% thereof for the purpose of development of the hotel industry in the City of Tahlequah, Oklahoma. AND WHEREAS, the City Council of the City of Tahlequah, Oklahoma, deems the request for the enactment of such proposed ordinance by the Electors of the City should be a ballot request, and that such question should be submitted at a special election to occur on the 28th day of August, 2018. AND WHEREAS, the City Council has determined that the proposition of the enactment of said ordinance by the Electors be submitted on the Official Ballot at said special election in the following language, to-wit: PROPOSITION Shall ordinance number 1263-2018, an ordinance levying an additional excise tax of 6% upon the gross rental receipts due from or paid by transient guests of substantial hotel rooms within the city of Tahlequah, Oklahoma; providing for exemptions; issuance of certificates of exemption; keeping of records; filing of records; payment of the tax by substantial hotel operators; compensating operators for collection of tax; fixing penalties for violation; providing that such tax funds be used exclusively for development of the hotel industry in the city of Tahlequah, Oklahoma; providing for an incentive rebate of a portion not to exceed 96% of the proceeds of the new excise tax to the operators of new substantial hotels as an incentive to develop new substantial hotels within the city of Tahlequah, Oklahoma; providing for a maximum term of the incentive rebate period of 20 years; providing for a 25-year term of the ordinance; submission of ordinance to electors for approval; and fixing the effective date of the ordinance, be approved and adopted? ______ YES - FOR THE ABOVE PROPOSITION ______ NO - AGAINST THE ABOVE PROPOSITION NOW, THEREFORE, be it resolved by the Mayor and City Council of the City of Tahlequah, Oklahoma, at a meeting duly-called and held this day, that the above stated proposition as to the enactment of said ordinance be submitted to the Electors of the City of Tahlequah in accordance with the proclamation of election to be issued by the Mayor.
