GREENSPOON MARDER, LLP 1125 West Street, Suite 265 Annapolis, MD 21401 SUBSTITUTE TRUSTEE’S SALE OF IMPROVED REAL PROPERTY KNOWN AS 12907 BEDFORD ROAD CUMBERLAND, MD 21502 AUGUST 21, 2018 AT 2:00 PM By virtue of a power of sale contained in a Deed of Trust from JAMES CORTES ZEMBOWER AND JOSEPHINE ZEMBOWER, dated FEBRUARY 27, 2009, and recorded in the Land Records of ALLEGANY COUNTY, Maryland, at Liber 1564, Folio 330, default having occurred under the terms thereof, the Substitute Trustee will sell at public auction located at the ALLEGANY COUNTY COURTHOUSE LOCATED AT 30 WASHINGTON STREET, CUMBERLAND, MD 21502. All that FEE SIMPLE lot of ground and the improvements thereon, situated in ALLEGANY COUNTY and being more fully described in the aforesaid Deed of Trust. FIRST PARCEL: ALL THAT LOT, PIECE AND PARCEL OF GROUND LYING ON THE NORTH SIDE OF THE BEDFORD ROAD, NEAR ZION CHURCH, IN ALLEGANY COUNTY, MARYLAND, DESCRIBED AS FOLLOWS, TO-WIT: BEGINNING AT A PLANTED STONE ON THE NORTHERLY SIDE OF BEDFORD ROAD, AT THE END OF A FENCE LINE TWENTY-FOUR FEET SIX INCHES FROM THE END OF THE LAST LINE ON A DEED FROM CHARLES W. FRANTZ AND ANNIE L. FRANTZ TO J. HOWARD FRANTZ, SAID DEED BEARING DATE OF APRIL 7, 1922, AND RECORDED IN LIBER NO. 140, FOLIO 170, ONE OF THE LAND RECORDS OF ALLEGANY COUNTY, MARYLAND, AND RUNNING WITH LAST SAID LINE SOUTH 42 DEGREES WEST SIXTY-FIVE FEET; THENCE NORTH 49 DEGREES WEST 130 FEET TO A STAKE; THEN NORTH 42 DEGREES EAST SIXTY-FIVE FEET TO INTERSECT THE LAST LINE IN A DEED FROM J. SAID DEED BEARING DATE OF JULY 25, 1925, AND RECORDED IN LIBER NO. 152, FOLIO 545 ONE OF THE SAID LAND RECORDS, THEN RUNNING WITH SAID LAST LINE BY A STRAIGHT LINE TO THE BEGINNING. SECOND PARCEL: ALL THAT LOT AND PARCEL OF GROUND LYING NORTH OF BEDFORD ROAD, NEAR ZION CHURCH, IN ALLEGANY COUNTY, MARYLAND, DESCRIBED AS FOLLOWS, TO-WIT: BEGINNING AT THE END OF THE SECOND LINE OF DEED FROM GEORGE A. ZEMBOWER AND WIFE TO THE SAID CORTES C. ZEMBOWER AND WIFE, SAID DEED BEARING DATE THE 15TH DAY OF MARCH 1930, AND RECORDED IN LIBER NO. 163, FOLIO 180, ONE OF THE LAND RECORDS OF ALLEGANY COUNTY, MARYLAND, AND EXTENDING SAID LINE NORTH 49 DEGREES WEST 38 FEET TO A STAKE; THEN RUNNING PARALLEL WITH THE THIRD LINE OF SAID DEED, NORTH 42 DEGREES EAST 65 FEET TO INTERSECT THE LAST LINE IN A DEED FROM J. HOWARD FRANTZ TO THE SAID FILLER A. ZEMBOWER AND WIFE, SAID DEED BEARING DATE THE 25TH DAY OF JULY, 1925, AND RECORDED IN LIBER NO. 152, FOLIO 545, ONE OF SAID LAND RECORDS; THEN RUNNING WITH SAID LAST LINE SOUTH 49 DEGREES EAST THIRTY-EIGHT FEET TO THE END OF THE THIRD LINE OF THE DEED FROM GEORGE A. ZEMBOWER AND WIFE TO THE PARTIES OF THE SECOND PART HEREIN, THEN BY A STRAIGHT LINE TO THE BEGINNING. The sale is subject to post-sale review of the status of the loan and that if any agreement to cancel the sale was entered into by the lender and borrower prior to the sale then the sale is void and the purchaser’s deposit shall be refunded without interest.  Purchaser must obtain possession and assumes risk of loss or damage to the property from the date of the auction forward. The property will be sold in an “as is” condition, without express or implied warranty as to the nature and description of the improvements as contained herein, and subject to conditions restrictions and agreements of record affecting the same, but omitting any covenant or restriction based on race, color, religion, sex, handicap, familial status or national origin, if any, and with no warranty of any kind. TERMS OF SALE: A deposit of $8,000.00 by certified check or cashier’s check will be required of the purchaser, if other than the note holder, at time and place of sale, balance in immediately available funds upon final ratification of sale by the Circuit Court for ALLEGANY County, Maryland, interest to be paid at the rate of 5% on unpaid purchase money from date of sale to date of settlement. The secured party herein, if a bidder, shall not be required to post a deposit. Third party purchaser (excluding the secured party) will be required to complete full settlement of the purchase of the property within TWENTY (20) CALENDAR DAYS of the ratification of the sale by the Circuit Court otherwise the purchaser’s deposit shall be forfeited and the property will be resold at the risk and expense of the defaulting purchaser. All other public charges and private charges or assessments, including water/sewer charges, ground rent, taxes, if any, to be adjusted to date of sale. Cost of all documentary stamps and transfer taxes and all other costs incident to the settlement shall be borne by the purchaser. If applicable, condominium and/or homeowner association dues and assessments due pursuant to Md. Real Property Article 11-110 and those that may become due after the time of sale will be the responsibility of the purchaser. Purchaser must obtain possession and assumes the risk of loss or damage to the property from the date of sale forward. If the sale is rescinded or not ratified for any reason, including post sale lender audit, or the Substitute Trustee is unable to convey good and marketable title, or a resale is to take place for any reason, the purchaser’s sole remedy in law or equity shall be limited to a refund of the aforementioned deposit. The purchaser waives all rights and claims against the Substitute Trustee whether known or unknown. These provisions shall survive settlement. Upon refund of the deposit, this sale shall be void and of no effect, and the purchaser shall have no further claim against Substitute Trustee.
