NOTICE OF INTENT TO REQUEST A RELEASE OF FUNDS (NOIRROF) November 5, 2015 Otsego County 197 Main Street Cooperstown, NY 13326 (607) 547-4202 On or about November 16, 2015, Otsego County will submit a request to the Office of Community Renewal for the release of CDBG funds under Title 1 of the Housing and Community Development Act of 1974, as amended, to undertake the following project: Program Title: Springbrook Program Location: Scattered sites within Otsego County Purpose of Project: A public facilities program to address code, safety, energy efficiency, and/or accessibility improvements needed at several Springbrook sites in Otsego County. Springbrook is a State Licensed not-for-profit organization that provides educational, therapeutic residential, service coordination and related services to individuals who have developmental disabilities. Springbrook will be a subrecipient of CDBG funds. This project is an eligible use of CDBG funds because it primarily benefits a Limited Clientele. Public facilities improvements (program cost: $400,000); and administration and program delivery (program cost: $50,000). Estimated Total Program Cost: $450,000 (CDBG: $400,000; Owner Equity: $50,000) The activities proposed comprise a project for which a Finding of No Significant Impact on the Environment was published on November 5, 2015. An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at the Otsego County Clerk of the Board's Office, 197 Main Street, Cooperstown, NY and may be examined or copied weekdays from 9 AM to 5 PM. PUBLIC COMMENTS An individual, group, or agency may submit written comments on the ERR to the Clerk of the Board's office at the above address. All comments received by November 13, 2015 will be considered by Otsego County prior to submission of a request for release of funds. RELEASE OF FUNDS Otsego County certifies to the Office of Community Renewal that Kathleen Clerk, Certifying Officer, in her official capacity as Chair of the Board of Representatives, consents to accept the jurisdiction of the Federal courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. The Office of Community Renewal's acceptance to the certification satisfies it responsibilities under NEPA and allows Otsego County to use Program Funds. OBJECTION TO RELEASE OF FUNDS The Office of Community Renewal will accept objections to its release of funds and Otsego County's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) that the certification was not in fact executed by the Chief Certifying Office of Otsego County; (b) Otsego County has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by the Office of Community Renewal; (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to: Christian Leo, Vice-President, at Office of Community Renewal, Hampton Plaza, 38-40 State Street, 4th Floor, Albany, New York 12207. Potential objectors should contact the Office of Community Renewal to verify the actual last day of the objection period.
