ALABAMA DEPARTMENT OF ENVIRONMENTAL MANAGEMENT PUBLIC NOTICE - 500 NOTICE OF RESPONSE TO COMMENTS RECEIVED DURING THE PUBLIC COMMENT PERIOD FROM JUNE 2, 2015, THROUGH JULY 15, 2015, AND PUBLIC HEARING ON JULY 15, 2015, ADEM ADMINISTRATIVE CODE CHAPTER 335-6-7 Notice is hereby given regarding the availability of the Department's response to comments (RTC) prepared as a result of comments received during the June 2, 2015, through July 15, 2015, public comment period, including a public hearing in Montgomery on July 15, 2015, relative to ADEM Admin. Code Ch. 335-6-7 [National Pollutant Discharge Elimination System (NPDES) Best Management Practices, Registration Requirements, Technical Standards And Guidelines, Construction And Operation Requirements, Waste/Wastewater And Waste Product Treatment, Storage, Handling, Transport, And Disposal/Land Application, Nutrient Management, And Animal Mortality Management Requirements For Owners And Operators Of Animal Feeding Operations (AFOs) And Concentrated Animal Feeding Operations (CAFOs)]. ADEM Admin. Code R. 335-6-7-.03(5) [Chapter Modification And Public Participation] provides for a public notice, 30-day comment period, and public hearing every 5-years to solicit public participation and comment regarding the content, implementation, and compliance with provisions of ADEM Admin. Code Ch. 335-6-7. Within 120-days after completion of the public participation process, a subsequent public notice is provided to inform the public regarding the Department's written response and a determination of the need, if any, to modify the rules to ensure continued consistency with the requirements of the Alabama Water Pollution Control Act. A copy of the Response to Comments (RTC) is available online via the ADEM eFile system at http://app.adem.alabama.gov/eFile/ under the document name “11-10-2015 HEAR RFH CAFO PROGRAM REVIEW - RESPONSE TO COMMENTS.pdf” or can be obtained by contacting the ADEM CAFO Hearing Officer by email at fieldmail@adem.state.al.us Inquiries regarding this notice should be directed to: ADEM CAFO Hearing Officer, Field Operations Division, Alabama Department of Environmental Management, P.O. Box 301463, Montgomery, AL 36130-1463 (street address: 1350 Coliseum Boulevard, Montgomery, AL 36110-2059). The current ADEM AFO/CAFO NPDES rules provide for a comprehensive regulatory program based on sound science with effective technical standards that provide for the protection of Alabama's water and air quality. The ADEM rules fully comply with applicable federal and State law and are greater in scope and meet or exceed current EPA regulations. As a result, the Department has determined that no action regarding the ADEM AFO/CAFO rules is needed at this time. The Department will continue to work with EPA and involved stakeholders to monitor future developments regarding federal CAFO regulations, will continue to be receptive to public input of technical substance, regulatory merit, or sound management principles that could result in a better program consistent with applicable State and federal laws, and will propose changes to the rules in the future as needed.
