Case No. CJ-2015-441-W NOTICE OF SHERIFF’S SALE Notice is given that on the 5th day of August, 2015, at 10:00 a.m., in Room 200 of the Cleveland County Office Building, the Sheriff of said county will offer for sale and sell for cash at public auction to the highest and best bidder all that certain real estate in Cleveland County, Oklahoma, to wit: Part of the Northeast Quarter (NE/4) of Section Nine (9), Township Nine (9) North, Range One (1) East of the Indian Meridian, Cleveland County, Oklahoma, and being more particularly described as follows: Beginning at a point 660.05 feet N00º42’58”W and 1764.35 feet S89º59’38”W of the Southeast Corner of the Northeast Quarter (SE/C NE/4); thence S89º59’38”W a distance of 381.00 feet; thence N0º00’22”W a distance of 1146.52 feet; thence East a distance of 381.00 feet; thence S00º00’22”E a distance of 1146.48 feet to the Point of Beginning; LESS AND EXCEPT that part of the Northeast Quarter (NE/4) of Section Nine (9), Township Nine (9) North, Range One (1) East of the Indian Meridian, Cleveland County, Oklahoma, more particularly described as beginning at a point 660.05 feet N00º42’53”W and S89º59’38”W 1764.35 from the Southeast Corner of the Northeast Quarter (SE/C NE/4) of said Section Nine (9); thence S89º59’38”W a distance of 381.00 feet; thence N00º22’22”W a distance of 75.00 feet; thence Southeasterly along a curve to the right (radius=75.00 feet) a distance of 92.32 feet; Thence N89º59’38”E a distance of 309.98 feet; thence S00º00’22”E a distance of 25.00 feet to the Point of Beginning. Sale will be made pursuant to a Writ of Execution issued upon a judgment entered on the 4th day of June, 2015, in the District Court of Cleveland County, Oklahoma, in Cause No. CJ-2015-441-W, wherein BancFirst was Plaintiff, and David E. Fuhs, the Unknown Heirs, Successors, and Assigns of Elizabeth L. Fuhs, deceased, and the Board of County Commissioners of Cleveland County, Oklahoma, were Defendants to satisfy Judgment in personam and in rem against David E. Fuhs, and in rem against the Unknown Heirs, Successors, and Assigns of Elizabeth L. Fuhs, deceased and the Board of County Commissioners of Cleveland County, Oklahoma, on the Mortgage of the principal balance of Forty-seven Thousand Six Hundred Twenty-one Dollars and Nine Cents (447,621.09), plus interest accrued in the amount of One Thousand Nine Hundred Thirty-three Dollars and 54/100 Cents ($1,933.54), with interest continuing from June 4, 2015, at the per diem contract rate of $7.828124383 until paid; for its attorneys’ fees in the amount of Three Thousand Dollars ($3,000.00); court costs in the amount of $238.70; and process server fees in the amount of $76.00, for a total judgment amount of Fifty-two Thousand Eight Hundred Sixty-nine & 33/100 Dollars ($52,869.33), as of June 4, 2015, together with reimbursement for all expenses advanced and accruing on behalf of these parties, for which amounts said Mortgage is a first lien against the property, further ordering that said property be sold to satisfy the lien of Plaintiff and for such relief that the Court deems just and proper.
