TRUSTEE'S SALE Trustee's Sale of valuable fee simple property improved by premises known as 13207 Yellow Row Road. N.W., Mount Savage, MD 21545. By virtue of the power and authority contained in a Deed of Trust from CARMEN C. BRENNAN AND LINDA C. TRIMBLE, dated July 31, 2001, and recorded in Liber 919 at Page 215 among the land records of the COUNTY OF ALLEGANY, in the original principal amount of $61,200.00. Upon default and request for sale, the undersigned trustees will offer for sale at public auction at the Courthouse for the COUNTY OF ALLEGANY, at 30 Washington Street, Cumberland, Maryland, on February 3, 2016 at 4:00 PM, all that property described in said Deed of Trust including but not limited to: ALL that piece or parcel of ground situated in Election District No. 13, Allegany County, Maryland, and being at the intersection of the southerly side of Yellow Row Extended and the westerly side of New School Road, and being in Mt. Savage, Allegany County, Maryland, and being more particularly described as follows: (Meridian is based on a deed dated October 18, 1977, Cora Pollock to Joseph F. and Jean F. Ginise, recorded in Deed Book 497, page 55, Allegany County Land Records, and Horizontal Measurements being used throughout), to-wit: BEGINNING for the same at a 5/8 inch iron pin with cap set, said iron pin also stands about 440 feet southwesterly from the above described intersection, thence leaving the right of way limits of New School Road, said iron pin also stands about 440 feet southwesterly from the above described intersection thence leaving the right of way limits of New School Road and running with a part of the seventh line reversed and the Cora Pollock to Joseph F. Ginise and Jean E. Ginise recorded in Deed Book 497, page 585, North 61 degrees 28 minutes 00 seconds West, 90.30 feet to a 5/8 inch iron pin with cap set, said iron pin being at the end of the sixth h.je of the above described Deed I3ook 497, page 585, said iron pin also being on the northerly side of the old tramroad right of way, thence continuing North 77 degrees 40 minutes 00 seconds West 202.80 feet to a concrete monument set, said monument stands on the northerly right of way limits of the above described old tramroad right of way, said monument also being at the end of the fifth line of the above described Deed Book 497, page 585, thence with the fifth line reversed, North 37 degrees 43 minutes 00 seconds East 139.60 feet to a 5/8 inch iron pin with cap set, said iron pin stands at the end of the fourth line of the above described Deed Book 497, page 585, said iron pin also being at the end of the second line of Parcel No. 1 of deed 497, page 55, thence leaving the lines of the above described Deed Book 497, page 585, and running with the third and fourth lines of the above described Deed Book 497, page 55, North 12 degrees 41 minutes 00 seconds East 202.13 feet to a 5/8 inch iron pin with cap set, said iron pin stands at the end of the third line of the above described Deed Book 497, page 55, said iron pin also stands at the end of the third line of a deed dated July 27, 1966, Cora Pollock to Ralph K. Pollock, recorded in Deed Book 399, page 113, South 73 degrees 37 minutes 00 seconds East, 195.85 feet to a concrete monument set, said monument stands at the end of the second line of the above described Deed Book 399, page 113, and running thence with the second line reversed of the above described Deed Book .399, page 113, North 28 degrees 33 minutes 00 seconds East 99.80 feet to a 5/8 inch iron pin with cap set, said iron pin stands at the end of the first line of the above described Deed Book 399, page 113, said iron pin also stands on the southerly right of way limits of the above described Yellow Row Extended and with said right of way limits, South 61 degrees 12 minutes 00 seconds East 30.00 feet to a concrete monument set, said monument stands on the southerly side of the above described Yellow Row Extended, thence leaving the right of way limits of the above described Yellow Row Extended and with two new division lines, South 28 degrees 33 minutes 00 seconds West, 151.45 feet to a 5/8 inch iron pin with cap set, said iron pin being a new corner as a result of a minor subdivision, and continuing South 61 degrees 12 minutes 00 seconds East 107.24 feet to a 5/8 inch iron pin with cap set, said iron pin stands on the right of way limits of the above described New School Road, thence ninning with the right of way limits of New School Road for the next course and distance by a curve to the left having a radius of 497.22 feet and running for a length of 269.05 feet to the place of BEGINNING, containing 2.08 acres, more or less. Said property is in fee simple and is improved by a dwelling and is sold in "as is condition" and subject to all superior covenants, conditions, liens, restrictions, easement, rights-of-way, as may affect same, if any. TERMS OF SALE: A deposit of 10% of the sale price, cash or certified funds shall be required at the time of sale. The balance of the purchase price with interest at 8% per annum from the date of sale to the date of payment will be paid within TEN DAYS after the final ratification of the sale. Adjustments on all taxes, public charges and special or regular assessments will be made as of the date of sale and thereafter assumed by purchaser. If applicable, condominium and/or homeowners association dues and assessments that may become due after the time of sale will be the responsibility of the purchaser. Title examination, conveyancing, state revenue stamps, transfer taxes, title insurance, and all other costs incident to settlement are to be paid by the purchaser. Time is of the essence for the purchaser, otherwise the deposit will be forfeited and the property may be resold at risk and costs of the defaulting purchaser. If the sale is not ratified or if the Substitute Trustees are unable to convey marketable title in accord with these terms of sale, the purchaser's only remedy is the return of the deposit.
