INVITATION FOR BIDS NOTICE IS HEREBY GIVEN, pursuant to Article 5A of the General Municipal Law of the State of New York that sealed bids are sought by THE CITY OF ONEONTA, NEW YORK For: CONTRACT NO. 4-G-2016 MAIN STREET STREETSCAPE IMPROVEMENTS GENERAL CONSTRUCTION Sealed bids will be received by the Purchasing Agent, Jamie McNamara, at her office at City Hall, 258 Main Street, Oneonta, New York, until 2:00 p.m., March 4th, 2016 at which time bids will be publicly opened, and read. Contract Documents and Specifications, are on file at 258 Main Street, Oneonta, New York 13820, Office of the Purchasing Agent. Copies of the Contract Documents may be obtained from the Purchasing Department during regular office hours or will be mailed to bidders on request. A $10 non-refundable fee to be charged for mailing each set when mailing is requested. All checks, money orders, etc., shall be made payable to the City of Oneonta. Bid documents are also available on the Internet at www.govbids.com by clicking on the link at that web address for the "Empire State Purchasing Group". A voluntary pre-bid meeting is scheduled for Wednesday, February 17th, 2016 at 10:00 a.m. at City Hall Conference Room, 258 Main Street, Oneonta, New York 13820. Addenda, if any, will be issued to only those persons whose name and address are on record with the Owner as having obtained the Contract Documents. At the bid opening the Contractor must supply a BID GUARANTEE of 5 percent of the TOTAL AMOUNT of the bid submitted. See Item 6 in Instructions to Bidders. Attention is called to the fact that not less than the minimum salaries and wages set forth in the Contract Documents (see Exhibits) must be paid on this project; that the Contractor must insure that employees and applicants for employment are not discriminated against because of their race, creed, color, religion, sex or national origin. The Contractor must also be aware that he must comply with the State wage rates under New York State Department of Labor PRC# 2016001168, as well as Labor Law 220, section 220-h, which requires that on all public work projects of at least $250,000.00, all laborers, workers and mechanics on the site be certified as having successfully completed the OSHA 10-hour construction safety and health course. In addition, the Contractor must also be aware that he must comply with the Federal wage rates under the Davis-Bacon Act, as amended (40 U.S.C. 276a to 276a-7) General Decision Number NY160037, and as supplemented by Department of Labor regulations (29 CFR part 5, "Labor Standards Provisions Applicable to Contracts Governing Federally Financed and Assisted Construction"). The Contractor must also be aware that their Bid must be in conformance with the following Copeland "Anti-Kickback" Act (18 U.S.C. 874 and 40 U.S.C. 276c) - All contracts and subgrants in excess of $2000 for construction or repair; Contract Work Hours and Safety Standards Act (40 U.S.C. 327-330) - Where applicable,for all construction contracts awarded in excess of $100,000; Patent Rights to Inventions Made Under a Contract or Agreement for the patent rights of the Federal Government and the Recipient in any resulting invention in accordance with 37 CFR part 401; Clean Air Act (42 U.S.C. 7401 et seq.) and the Federal Water Pollution Control Act (33 U.S.C. 1251 et sea.), as amended - for Contracts and subgrants of amounts in excess of $100,000 that requires compliance with all applicable standards; and, Section 3 12 U.S.C. 1701u of The Housing and Community Development Act of 1968, as amended - for all contracts subject to Section 3 which shall include the clause set forth at 24 CFR 135.38 as provided in the Section 3 Rider provided with the Contract Documents. The Contractor must also be aware that in conformance with Workers' Compensation Law 57, contractor must provide either form CE-200 (Certificate of Attestation of Exemption from NYS Workers' Compensation and/or Disability Benefits Coverage), or form C-105.2 (Certificate of Workers' Compensation Insurance), or form SI-12 (Certificate of Workers' Compensation Self- Insurance) http://www.wcb.state.ny.us/content/main/Employers/IM.pdf before Notice to Proceed can be issued. Bidders are responsible for the timely delivery of their Bid proposal to the proper department as indicated in this "Invitation to Bid". Bid proposals received after the date and time specified in the Invitation shall be considered unresponsive and will be returned to the Bidder unopened. The City of Oneonta does not accept bids by FAX. Bidders are advised not to rely on the Postal Service or any other mail delivery service for the timely and proper delivery of their bid proposals. In the event of a tie bid, the winner will be determined by coin toss. The Owner reserves the right to reject any and all Bids or waive any informality in the Bidding. Bids may be held by the Owner for a period not to exceed forty-five (45) days from the date of the openings of Bids for the purpose of reviewing the Bids and investigate the qualifications of the Bidders, prior to awarding the Contract. This Contract is subject to New York State wage rate schedules. The City of Oneonta encourages the submission of bids by companies that are certified as Minority-owned, Women-owned and Disadvantaged Business Enterprises.
