Notice is given that on September 2, 2015, at 10:00 oclock a.m. at the Cleveland County Courthouse in Norman, Oklahoma, the Sheriff of Cleveland County will offer for sale and sell at public auction, for cash, to the highest and best bidder, subject to the appraisement thereof fixed in the sum of $87,000, all that certain real property located in Cleveland County, Oklahoma, described as follows: Lot Three (3) and the South 25 feet of Lot Four (4), in Block Five (5), of EASTLAND PARK ADDITION, to the Town of Lexington, Cleveland County, Oklahoma, according to the recorded plat thereof. said property having a physical address of 622 S.E. 6th St., Lexington, OK 73051, subject to taxes and tax sales, if any. The sale will be made pursuant to a Special Execution and Order of Sale issued upon a judgment entered in the District Court of Cleveland County, Oklahoma in the above-entitled and numbered cause, wherein DUSTIN MAHORNEY was plaintiff and MICHAEL E. BARBER, KRISTIN BARBER, STATE OF OKLAHOMA EX REL OKLAHOMA TAX COMMISSION and NORMAN REGIONAL HOSPITAL AUTHORITY, A PUBLIC TRUST; were defendants, and the proceeds of said sale shall be paid to the Clerk of this Court, as provided by law, for application as follows: FIRST: To the payment of the costs of said sale and of this action; SECOND: To the payment of the judgment herein awarded to plaintiff in the sum of $4,000 plus interest thereon from July 9, 2015, plus interest and late charges thereafter at the rates prescribed in said note, abstracting expenses in the sum of $300.00, prejudgment costs of this action in the amount of $469.98, and an attorney fee in the sum of $3,000.00, as provided for in said note and mortgage, and plus additional advances for taxes, insurance, or expenses for the protection and preservation of the subject property during the pendency of this action; and THIRD: The balance, if any, to be paid to the Clerk of this Court, to await the further Order of the Court.
