CITATION THE STATE OF TEXAS AUGUST 10, 2015 TO: MICHAEL JAMES ELLIS, INDEPENDENT EXECUTOR OF THE ESTATE OF DONNA M. ELLIS, AND THE UNKNOWN HEIRS AT LAW OF JAMES R. ELLIS NOTICE: YOU HAVE BEEN SUED. You may employ an attorney. If you or your attorney do not file a written answer with the clerk who issued this citation by 10:00 am on the Monday next following the expiration of forty-two (42) days from the issuance of this citation, the same being Monday, September 28th, 2015, a default judgment may be taken against you. A brief statement of the nature of this suit is as follows, to-wit: NATIONSTAR MORTGAGE LLC D/B/A CHAMPION MORTGAGE COMPANY (”PLAINTIFF”), ITS SUCCESSORS IN INTEREST OR ASSIGNS, BY AND THROUGH ITS ATTORNEY OF RECORD, JONATHAN M. WILLIAMS OR MARINOSCI LAW GROUP, PC, DBA MARINOSCI & BAXTER, 14643 DALLAS PARKWAY, SUITE 750, DALLAS, TEXAS 75254, (972)331-2300, BROUGHT SUIT AGAINST THE ESTATE OF JAMES R. ELLIS, MICHAEL JAMES ELLIS, INDEPENDENT EXECUTOR OF THE ESTATE OF DONNA M. ELLIS, AND THE UNKNOWN HEIRS OF JAMES R. ELLIS, TO ENFORCE THE FIXED RATE NOTE HOME EQUITY CONVERSION CLOSED- END (”NOTE”) ON THE PROPERTY LOCATED AT 2948 BETHEL RD., WEATHERFORD, TX 76087 AND LEGALLY DESCRIBED AS: Being a 43,560 square feet tract or parcel of land situate in the John Davis survey, Abstract No. 349, Parker County, Texas being the same tract of land conveyed by deed to James R. Ellis and wife, Donna Ellis as recorded in Volume 624, Page 114, Deed Records, Parker County, Texas (DRPCT) and being described by metes and bounds as follows: Beginning at a 1/2 inch rebar found at the northeast corner of said Ellis Tract, also being located in the northwesterly right of way line of Bethel Road (F.M. Hwy. 1884) and being 219.4 feet west of the West line of subdivision in the name of Mrs. J. S. Harris and 619.0 feet North of the South line of the John Davis Survey; Thence South 27 degrees 31 minutes 00 seconds West, along said northwesterly right of way line of said Bethel Road a distance of 112.80 feet to a 1/2 inch rebar found at the northeast corner of Country View Mobile Home Park; Thence South 90 degrees 00 minutes 00 seconds West, along the north line of said Mobile Home Park a distance of 409.55 feet to a 2 inch iron pipe found for the corner; Thence North 00 degrees 00 minutes 00 seconds East a distance of 100,000 feet to a 4 inch iron pipe found for corner; Thence North 90 degrees 00 minutes 00 seconds East along the south line of a 10.17 acre tract of land a distance of 461.65 feet to the Point of Beginning and containing 43,560 square feet of land or 1.00 acres more or less. As is more fully shown by Plaintiff’s Petition on file in this suit. The suit is numbered CV15-0227 and was filed in the 415th District Court in and for Parker County on February 17, 2015, and styled: NATIONSTAR MORTGAGE LLC D/B/A CHAMPION MORTGAGE COMPANY VS. THE ESTATE OF JAMES R. ELLIS, MICHAEL JAMES ELLIS, INDEPENDENT EXECUTOR OF THE ESTATE OF DONNA M. ELLIS, AND THE UNKNOWN HEIRS OF JAMES R. ELLIS, AND 2948 BETHEL RD., WEATHERFORD, TX 76087, IN REM ISSUED under my hand and seal in Weatherford, Parker County, Texas on this 10th day of August, 2015.
