____________________________________ LEGAL NOTICE ____________________________________ COMBINED NOTICE OF FINDING OF NO SIGNIFICANT IMPACT AND INTENT TO REQUEST RELEASE OF FUNDS October 31, 2015 Oklahoma Housing Finance Agency Attn: John Marshall 100 N.W. 63rd St., Suite 200 Oklahoma City, OK 73116 (405) 419-8280 This Notice shall satisfy the above-cited two separate but related procedural notification requirements REQUEST FOR RELEASE OF FUNDS On or about November 18, 2015 the Oklahoma Housing Finance Agency will submit a request to the U.S. Department of Housing and Urban Development, Oklahoma for the release of HOME Investment Partnerships Program (HOME) funds under Title II of the Cranston-Gonzales National Affordable Housing Act of 1990 to undertake a project known as Legacy Senior Residences, for the purpose of new construction of a forty-eight unit independent senior living development for an estimated development cost of $7,840,173 which includes $500,000 of HOME funds to be located at 1929 North Country Club Road, Ada, Oklahoma, 74820. FINDING OF NO SIGNIFICANT IMPACT The Oklahoma Housing Finance Agency has determined that the project will have no significant impact on the human environment. Therefore, an Environmental Impact Statement under the National Environmental Policy Act of 1969 (NEPA) is not required. Additional project information is contained in the Environmental Review Record (ERR) on file at the Oklahoma Housing Finance Agency, 100 NW 63rd St., Suite 200, Oklahoma City, OK 73116 and may be examined or copied weekdays from 8:30 A.M. to 4:30 P.M. PUBLIC COMMENTS Any individual, group, or agency disagreeing with this determination or wishing to comment on the project may submit written comments to the Oklahoma Housing Finance Agency, Attn: John Marshall, 100 NW 63rd St., Suite 200, Oklahoma City, OK 73116 or PO Box 26720, Oklahoma City, OK 73126-0720. All comments received by November 17, 2015 will be considered by the Oklahoma Housing Finance Agency prior to authorizing the submission of a request for release of funds. Commentors should specify which part of this Notice they are addressing. RELEASE OF FUNDS The Oklahoma Housing Finance Agency certifies to the U.S. Department of Housing and Urban Development, Oklahoma that John Marshall in his capacity as Housing Development Team Leader consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. U.S. Department of Housing and Urban Development, Oklahomas approval of the certification satisfies its responsibilities under NEPA and related laws and authorities, and allows the Oklahoma Housing Finance Agency to use Program funds. OBJECTIONS TO RELEASE OF FUNDS U.S. Department of Housing and Urban Development, Oklahoma will consider objections to its release of funds and the Oklahoma Housing Finance Agencys certification received by December 3, 2015 or a period of fifteen days from its receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer or other officer of the Oklahoma Housing Finance Agency approved by U.S. Department of Housing and Urban Development, Oklahoma; (b) the Oklahoma Housing Finance Agency has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR Part 58; (c) the grant recipient or other participants in the project have committed funds or incurred costs not authorized by 24 CFR Part 58 before approval of a release of funds by the U.S. Department of Housing and Urban Development, Oklahoma; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58) and shall be addressed to the U.S. Department of Housing and Urban Development, Attn: Community Planning & Development, 301 NW 6th St., Suite 200, Oklahoma City, OK 73102.
