REQUEST FOR PROPOSALS Sealed proposals addressed to the Greater Texoma Utility Authority (GTUA, Owner) on behalf of the City of Sherman will be received at the offices of the Director of Utilities, Sherman City Hall, 220 W. Mulberry, Sherman, TX 75090 between 8 A.M. and 2 P.M. on December 1, 2015 for furnishing all necessary material, equipment and labor required for the construction of the following project: CITY OF SHERMAN SOUTHWEST 1.5 M.G. ELEVATED TANK Bids will be opened at the offices of the Director of Utilities, Sherman City Hall, beginning at 2 P.M. on December 1, 2015. The project consists of furnishing all materials, labor and equipment to construct a 1,500,000 gallon Composite Elevated Storage Tank including piping, valves, drainage, paving, storm sewers, doors, hatches, stairs, ladders, erosion protection, electrical, instrumentation together with all appurtenances. The project also includes improvements at the existing 2,000,000 gallon Gallagher elevated tank. Bidders on each contract must submit with their bids a Cashier's Check or a Certified Check in the amount of five (5%) percent of the maximum amount of bid payable without recourse to the Great Texoma Utility Authority or a proposal bond in the same amount from a Surety Company holding permit from the State of Texas to act as Surety. Bids without checks or proposal bonds will not be considered. In accordance with Article 5160, Revised Civil Statutes of Texas, 1925, as amended, the successful Bidder will be required to furnish not only a performance bond in the amount of the contract, but also a payment bond for the protection of all claimants supplying labor and materials as defined in said law. The bonds must be executed by an approved Surety Company holding a permit from the State of Texas to act as Surety. The Owner reserves the right to reject any or all bids and to waive informalities. In case of ambiguity or lack of clearness in stating the price in the bids, the Owner reserves the right to consider the most advantageous construction thereof or to reject the bid. Unreasonable or unbalanced unit prices will be considered sufficient cause for rejection of any bid. Bids may be held by the Great Texoma Utility Authority for a period not to exceed 30 days from the date of the bid opening for the purpose of reviewing the bids and investigating the bidders qualifications prior to the contract award. Any contract or contracts awarded under this Invitation for Bids are expected to be funded in part by a loan from the Texas Water Development Board, and shall be referred to as Project DWSRF 62648. Neither the State of Texas nor any of its departments, agencies, or employees is or will be a party to this Invitation for Bids or any resulting contract. All qualified applicants will receive consideration for employment without regard to race, color, religion, sex, or national origin. Bidders on this work will be required to comply with the President's Executive Order No. 11246, as amended by Executive Order 11375, and as supplemented in Department of Labor regulations 41 CFR Part 60. The requirements for bidders and contractors under this order are explained in the specifications. AIS provisions apply to all DWSRF loans closed after January 17, 2014. Any contract(s) awarded under this Invitation for Bids is/are subject to the American Iron and Steel (AIS) requirements of P.L. 113-235 Consolidated and Further Continuing Appropriations Act 2015. The contract is subject to the Environmental Protection Agency's (EPA) "fair share policy", which includes EPA-approved fair share goals" for Minority Business Enterprise (MBE) and Women Business Enterprise (WBE) firms in the Construction, Supplies, Equipment, and Services procurement categories. EPA's policy requires that applicants and prime contractors make a good faith effort to award a fair share of contracts, subcontracts, and procurements to Minority Business Enterprise and Women-Owned Business Enterprise firms. Although EPAs policy does not mandate that the fair share goals be achieved, it does require applicants and prime contractors to demonstrate use of the six affirmative steps.
