AN ORDINANCE AMENDING CHAPTER 21, MOULTON CODE OF ORDINANCES PERTAINING TO THE LIBRARY BOARD WHEREAS, the City of Moulton had previously passed an ordinance which added to the number of Library Board Members, on or about May 7, 2007. WHEREAS, modification of the number of members of the Library Board requires a referendum of voters. WHEREAS, a referendum modifying the number of members of the Library Board was passed and approved by voters in election held November 3, 2015. WHEREAS, the Library Board had recently been acting as if the May 7, 2007 Ordinance amendment was void, and had acted, upon notification as such, by only five members as had previously been the number of members. WHEREAS, The Library Board desires to have seven members WHEREAS, the City Council agrees. WHEREAS, the citizens of Moulton, Iowa by referendum agree. BE IT ENACTED BY THE CITY COUNCIL OF THE CITY OF MOULTON, IOWA: SECTION 21.13 CREATED 21.13. LIBRARY TRUSTEES. The Board of Trustees of the Library, hereinafter referred to as the Board, consists of a seven members, at least four (4) of whom are residents of the City of Moulton, and at most three (3) nonresident members. all resident members are to be appointed by the Mayor with the approval of the Appanoose County Board of Supervisors. SECTION 21.14 CREATED 21.14 QUALIFICATIONS OF TRUSTEES. All resident members of the Board shall be bona fide citizens and residents of the City. All nonresident members of the Board shall be bona fide citizens and residents of the unicorporated Appanoose County. Members shall be over the age of eighteen (18) years of age and otherwise competent. SECTION 21.15 CREATED 21.15 ORGANIZATION OF THE BOARD. The Organization of the Board shall be as follows: 1. Term of Office. All appointments to the Board shall be for six (6) years, except to fill vacancies. Each term shall commence on July first, except for the addition of the two new members whose positions have been created in this ordinance, whose first term will extend to the June 30, 2019, and thereafter every six years. Periodic appointments shall be made every tow (2) years of approximately one-third of the total number to stagger the terms. 2. Vacancies. The position of any resident Trustee shall be vacated if such member moves permanently from the County. The position of any Trustee shall be deemed vacated if such member is absent from six (6) consecutive regular meeting of the Board, except in cases of sickness or temporary absence from the City of County. Vacancies in the Board shall be filled in the same manner as an original appointment except that the new Trustee shall fill out the unexpired term for which the appointment is made. 3. Compensation. Trustees shall receive no compensation for their service. The Board is permitted in their sole discretion to authorize reimbursement to a Trustee for reasonable preauthorized expenses of a Trustee, incurred in their service to the benefit of the Library Board, such as mileage to and from training, etc. WHEN EFFECTIVE. This ordinance shall be in effect from and after its final passage, approval and publication as provided by law.
